Globalisation & Law Network seminar with Gesa Kübek
On 31 October 2024, the Globalisation & Law Network hosted a seminar featuring Dr Gesa Kübek, Assistant Professor in European Law at Groningen University. Co-organised with the Institute for Globalisation and International Regulation (IGIR), the seminar served as a book launch, where Gesa presented her recent monograph, EU Trade and Investment Treaty-Making Post-Lisbon: Moving Beyond Mixity (Hart Publishing, 2024). The discussion was led by Dominic Coppens (IGIR) and Belén Gracia (IGIR and the Globalisation & Law Network).
The monograph sets out the in-depth legal analysis of mixity - the joint negotiation, conclusion, and ratification of agreements by the EU and its Member States - from the perspectives of international, EU, and national law. Gesa first briefly addressed the evolution of mixity, highlighting the different types of mixed agreements and the peculiarities of the mixed procedure. Then, she demonstrated why the practice of mixity no longer merely aims to avoid the lack of clarity regarding the division of trade and investment competences between the EU and the Member States. Rather, mixity is currently used as a substantive design choice. Finally, Gesa offered four propositions on moving beyond mixity. As the threat towards global isolationism and protectionism is becoming more acute, it is crucial to carefully decide by whom, with whom and in what way external power should be exercised.
